57 p.La siguiente tesis no es autorizada por el autor para su difusión en formato digitaEn la actualidad, donde la ciencia va siempre un paso delante de las demás disciplinas como el Derecho, se hace cada vez más difícil adaptar la normativa legal de un país a los hechos, sin cambiar los antiguos paradigmas que nos han regido durante tanto tiempo, para avanzar finalmente hacia un cambio definitivo que de solución a los problemas que nos aquejan y esté más acorde con la realidad. Los adelantos científicos que ha xperimentado el hombre mediante la investigación sobre técnicas de reproducción asistida son inimaginables, llegando a cambiar hasta los conceptos básicos que nos determinan como seres humanos, incluso la propia maternidad. El resultado esperado de este trabajo es investigar en profundidad la legislación nacional y extranjera con respecto a la maternidad subrogada, y llegar a precisar sus conceptos y problemática en la búsqueda de soluciones, utilizando como método la investigación jurídico dogmática./ ABSTRACT: At present, where the science goes always a step in front of other disciplines as the right, it becomes increasingly difficult to adapt the legal regulation of a country to the facts, without changing the former paradigms that have governed us during so much time, to advance finally towards a definitive change that gives solution to the problems that afflict us and it is more according to the reality. The scientific advances that the man has experienced by means of the investigation on technologies of assisted reproduction are unimaginable, managing to change up to the basic concepts that determine us as human beings, enclosedly the own maternity. The result expected from this work is to investigate in depth the national and foreign legislation with regard to the replaced maternity, and to manage to need the concepts and problematics in the search of solutions, using as method the juridical dogmatic investigation.
