47 p.En la relación entre la actual configuración de la sociedad y el sistema penal existe, como uno de los puntos nucleares, la construcción de la idea de bien jurídico, la que predominantemente se ha construido desde las bases del Derecho Penal Liberal hasta las últimas aportaciones funcionalistas. Sin embargo, poco se ha discutido si este constructo puede ser revisado en torno a la estructura de un sistema social diverso al imperante, y que existe, como el Socialista. En cuanto a la metodología utilizada es del tipo jurídico dogmática, utilizando como fuentes para la construcción de un conocimiento jurídico dogmático la doctrina jurídica y la ley. Por su parte, el tipo de investigación es histórico, comparativo y sociológico. Por último, el resultado obtenido en esta Memoria es conocer el actual concepto y el desarrollo histórico del objeto jurídico dentro de los sistemas políticos contemporáneos, principalmente el Socialista./ Abstract: In the relation between the current configuration of society and the criminal justice system exists, as one of the nuclear points, the construction of the idea of legal right, which is predominantly, built from the foundations of liberal criminal law to the last functionalist contributions. Nevertheless, not much has been said about if this construction can be reviewed regarding the structure of a different social system than the predominant one, but existent, like the Socialist one. The methodology used is legal dogmatic, using as sources for the construction of legal dogmatic knowledge, the doctrine and the law. On the other hand, the type of research is historical, comparative, and sociological. Finally, the result obtained in this research is to understand the current concept and the historical development of the legal object in the current political systems, specially the Socialist ones.
