En el ordenamiento jurídico colombiano los miembros de la Fuerza Pública conformada por las Fuerzas Militares y la Policía Nacional, cuentan con los respectivos marcos normativos que amparan su ejercicio profesional y que, entre otros aspectos, definen las causales de retiro, las cuales, desde luego, afectan el libre desempeño de quienes han escogido este medio de vida. Dentro de dicho contexto, la separación del servicio con fundamento en la facultad discrecional es un tema que ha sido objeto de discusión ante la jurisdicción de lo contencioso administrativo, con ocasión de los procesos de nulidad y restablecimiento del derecho entablados con finalidad no solo de obtener la anulación del acto que definió su situación de retiro de la respectiva institución, sino también de recibir aquellas sumas dejadas de percibir por virtud de este. Es relevante anotar que, por definición legal, la pretensión de nulidad y restablecimiento del derecho busca que el afectado por un acto expedido en ejercicio de la función administrativa, que para lo relevante a esta investigación será un policía o militar, obtenga su anulación, se le restablezca en su derecho subjetivo vulnerado, así como la reparación del daño que este le haya causado al accionante, si es que hay lugar a ello. Desde un punto de vista doctrinario, el contencioso de anulación puede darse a “solicitud de cualquier persona, natural o jurídica, pública o privada. El de nulidad y restablecimiento del derecho, solo se otorga al que se crea lesionado. Esto establece la legitimación por activa garantizando los derechos fundamentales” (Restrepo, 2014, pág. 6), que, para el caso, podrían ser el debido proceso y el plazo razonable. Within this context, the separation of the service based on the discretionary power is a subject that has been the subject of discussion before the jurisdiction of the administrative contentious, on the occasion of the nullity and restoration of the law proceedings with the purpose of not only obtaining the annulment of the act that defined his retirement situation of the respective institution, but also of receiving those sums left to be received by virtue of this. It is important to note that, by legal definition, the claim for nullity and reinstatement of the right seeks that the affected by an act issued in the exercise of the administrative function, which for the relevant to this investigation will be a police or military, obtain its cancellation, restore him in his subjective right violated, as well as the repair of the damage that this has caused to the plaintiff, if there is room for it. From a doctrinal point of view, the annulment dispute can be given at the request of any person, natural or legal, public or private. The nullity and restoration of the right is only granted to the one who believes himself injured. This establishes legitimization by active guaranteeing fundamental rights "(Restrepo, 2014, page 6), which, in this case, could be due process and reasonable time.
