Protección del Derecho a la Salud Respecto del Control de Precios de Medicamentos y su Impacto en el Estado Social de Derecho Colombiano

Abstract

The purpose of this research is to show the current situation of the Colombian health system with respect to the state’s function of controlling the price of medicines and its impact on the protection of the fundamental right to health. In the development of this problematic issue, it will be possible to evidence the level of efficiency of the State’s actions and the transcendence of the mechanism of protection, reflected in the active protagonism of the judicial function, in defense of the protected right. Finally, strategies are presented that contribute to the resolution of the problem posed, for the sake of timely and efficient access to medicines, in pursuit of the right to health and the materialization of the Social State of Law.
