dc.descriptionThis article analyzes the complex subject of the right to remembrance as a cultural human right, as well as its recognition on the chilean system of law. The paper refers to the problem of the recognition of new fundamental rights as well as the different ways to make it effective, in order to analyze the structure of such right in relation to its essential content, ownership and guaranties. Finally, it alludes to the subject of protection to such implicit right through the systematic interpretation of Chilean law.en-US
dc.descriptionRESUMENEl artículo analiza el complejo tema del derecho a la memoria como derecho humano de carácter cultural así como su consagración en el ordenamiento jurídico chileno. El trabajo alude a la problemática del reconocimiento de los nuevos derechos fundamentales y el modo de hacerlos efectivos, para lo cual se analizará la estructura de dicho derecho en cuanto a su contenido esencial, titularidad y garantías. Finalmente, se plantea el tema de la protección de los derechos implícitos a través de una interpretación sistemática del sistema constitucional chileno.es-ES
