Abstract
This work seeks to resolve the ethical-legal dilemma of informed consent, by carrying out a weighting in the medical assistance relationship; taking into account the importance of informed consent in medical practices in Colombia. At the same time the need seeks to highlight the importance of bioethics in the context of medical practices based on the ethical principles of the medical care relationship.
For this reason, the question that will be developed in this work is How does informed consent, as a right, allow the study that derives an analysis that seeks equality between the rights of the patient and the duties of health professionals in Colombia?
For the development of this question we will seek to identify informed consent, as a right that allows the balance between the rights of the patient and the duties of health professionals, to account for the tensions between the rights of the patient and the duty of In addition, information on medical practice in Colombia will also focus on comparisons between the different conceptions about informed consent and its development in Spanish-speaking countries, the application of bioethics principles and their limits, and finally the components will be highlighted. legal frameworks that frame the informed consent present in the patient medical relationship in Colombia.
The work will reflect the ethical and legal reality present in the informed consent, through the study of each of the bioethical principles and the study and jurisprudential analysis of the sentences pronounced by the Constitutional Court of Colombia between 2002 and 2013, so that In this way, the current situation of the subject can be established, since health is a fundamental right, as expressed in this work.
