Abstract

The purpose of this monograph is to establish the violation of the fundamental rights of the victims to truth, justice and reparation in Colombia generated with the estoppel due to the expiration of procedural terms in Colombia; for this, it starts from the identification of the nature and causes of the preclusion of the investigation in the Colombian criminal process; Similarly, the effects of the preclusion of the criminal investigation due to the expiration of the maximum term provided for in article 175 of the Code of Criminal Procedure, referred by article 294, are described; and finally, the positions emanating from the Constitutional Court and the Supreme Court of Justice regarding the rights of victims are analyzed when causal 7 of article 332 of the Colombian Code of Criminal Procedure is applied.
