Recent developments in medical science, as well as the growing sub-specialization in health sciences, demand the involvement of various professionals in the medical act. Causation of results considered unlawful by the criminal sta-tute in medical procedures of this nature, call for a clear determination of the subject of a criminal claim. For this purpose modern doc-trine applies the so-called trustprinciple. This article explores the concept, the assumptions and some cases that appear as problematic in the application of this principle in the medical field.
