Indigenous peoples enjoy the human rights and fundamental freedoms enshrined in the Political Constitution, in ILO Convention 169 of 1989 (Law 21 of 1991) and in other regulatory norms. However, the State has not been able to assimilate the existing cultural diversity in our country, although Colombia has several obligations aimed at protecting the rights of these peoples and guaranteeing respect for their integrity, which currently constitutes a challenge for governance, democracy and the citizenship. It is essential to carry out coordinated and systematic action with measures that ensure that these peoples enjoy the rights and opportunities granted to the rest of the population and promote the effectiveness of the social, economic, environmental and cultural rights of which they are holders. The current escalation of conflicts in Colombia requires an urgent and effective response, with policies and controls that translate into respect for the rights of indigenous peoples. As the author proposes, we cannot ignore that solving problems and guaranteeing the rights of indigenous peoples are an important factor in the construction of peace in Colombia.
