| dc.description | El interés en esclarecer los hechos y el interés por tutelar los derechos fundamentales constituyen, de acuerdo con la doctrina prevaleciente, pretensiones incompatibles en el ámbito procesal penal. Sin embargo, esa contraposición necesaria es resultado de un inadecuado análisis respecto del modo en que se relacionan ambos intereses. En efecto, mientras la indemnidad de algunos derechos fundamentales puede perjudicar el esclarecimiento de los hechos, la indemnidad de otros puede favorecer una decisión procesal penal más ajustada al modo en que realmente ocurrieron los hechos. | |
| dc.description | The interest in clarifying the facts and the interest to protect fundamental rights are, according to the prevailing doctrine, incompatible claims in the area of criminal procedure. However, the necessary contrast is the result of inadequate analysis as to how both interests relate. Indeed, while the indemnity of certain fundamental rights may interfere with determination of facts, the indemnity of others may encourage criminal procedural decision best suited to the way it really happened. | |
