| dc.description | En este artículo, primeramente, se efectúa una revisión panorámica del estado actual de la reglamentación sobre relación directa y regular con el niño tanto en el Código Civil como en otros cuerpos normativos. Enseguida, se analiza la figura bajo el prisma de los principios que inspiraron la reforma filiativa, a saber, igualdad jurídica, supremacía del interés del niño y derecho a la identidad, recurriendo a jurisprudencia nacional y extranjera. A continuación, se aborda el escasamente conocido Síndrome de Alienación Parental (S.A.P.) por su directa conexión con los conflictos sobre tuición y régimen de contacto, derivados de la separación conyugal. Y en la parte final de este trabajo, se propone la mediación familiar como escenario propicio para abordar estos conflictos de manera colaborativa preservando de mejor modo la garantía constitucional de autonomía de la familia en tanto grupo intermedio y el principio del interés superior del niño. | |
| dc.description | In this article, firstly, is an overview of the current revision of the regulation on direct and regular with the child in the Civil Code and other regulations. Then, the figure is discussed from the perspective of the principles underlying the reform of filiation, namely jegal equality, supremacy of the interests of the child and the right to identity, using domestic and foreign jurisprudence. Then, addressing the little-known Parental Alienation Syndrome (SAP) for its direct connection with disputes over custody and contact arrangements for children, arising from marital separation. And in the final part of this work is proposed as a family mediation proper scenario for addressing these conflicts collaboratively to better preserve the constitutional guarantee of autonomy of the family as middle group and the principle of best interests of the child. | |
