dc.description.abstractThis article seeks to reflect on the recognition of guarantees to groups of special protection that has had an impact on the legal construction of a special category of subjects. The purpose is to show how the recognition of those “subjects of special constitutional protection” has taken relevance with the Political Constitution of 1991 and its interpretation by the Constitutional Court. From a descriptive and interpretative approach at the international level, advances have been made from the protection of ethnic minorities to the specific recognition of other subjects, which is influencing the Colombian legal system that recognizes groups of special protection either for “conditions of manifest weakness” or for the position of ‘helplessness’. Jurisprudence has represented the greatest advance so the State will be responsible for the affirmative actions for the protection and special guarantee of these subjects and their rights in application of the principle/right to equal opportunities and non-discrimination.
