Contract law is not a stranger to concerns about the realization of social rights such as housing space. The celebration and implementation of contracts that allow access to ownership or possession of a home are areas where citizens daily contesting the enforceability of their housing rights. In that sense, this paper analyzes the impact of constitutionalization in contractual arrangements that allow access to housing and tools from the contractual right under the housing offer tenure in Colombia. To achieve this objective, the author presents the contributions that Colombian constitutional jurisprudence has made the contractual right to think of housing as a guarantee for the protection of the right to decent and adequate housing.
