dc.description.abstractCountless unsanitary hovels, without any condition to worthily accommodate a family, often in hazardous areas, of third-party or environmental preservation, are the sad sight of many Brazilian cities. In this vein, environmental injustices and violations of the right to health and adequate housing become routine: the fundamental rights under the Magna Letter don’t happen in practice. The city is organized to protect the interests of the moneyed class and lowincome settlements are relegated to neglect. This scenario, coupled with the failure of state action, and before the exposure of these groups vulnerable to malnutrition, illness, unemployment, environmental degradation and risk of life, has motivated common people to take the initiative, as concerned citizens, to act in transforming their community, such as the Project Brazil without cracks. Such individuals are ensuring solidarity rights which, being directed to the community, involve rights and duties. In this sense, the solidarity happens in its horizontal form. Thus is raised the following issues: what are the limits and possibilities for the development of structures and legal decisions that contribute to the realization of access to housing, referenced through the environmental aspects, as a solidarity right? It aims to demonstrate this panorama discoursing about the constitutional rights to decent housing, quality of life and ecologically balanced environment, referenced through the social and environmental aspects, as solidarity rights. All this making use of the procedure of bibliographical and documentary analysis and monographic method (case study), based on the theory of Systemic - Complex, producing notes and extended abstracts, combined with intensive direct observation. Finally, it is concluded that, in a society guided by individualistic values and economic developments, there are still people willing to do their part as citizens. Thus, the rights of solidarity, although as primarily an obligation of the State, are also effected by actions taken by the population.
