dc.description.abstractThe accelerated and disorderly urbanization of the last decades in the country has caused several environmental problems that reflect in the quality of life in the city. One of the ways to correct this scenario of degradation is through the search for the balance between urban space and nature, which can be reached by the convergence between Environmental Law and Urban Law. One of the urban-environmental problems is the progressive decrease of vegetation cover in urban areas, with green areas being ways to restore environmental harmony, as well as being indispensable elements for the socio-environmental function of cities. The present work seeks to analyze the green areas, their importance and their legal protection, focusing on plan of subdivision destined to housing of social interest, noticing that in land subdivisions a percentage should be reserved for free spaces, with implantation of green areas. The study comprised a bibliographical survey and analysis of legislation and legal principles related to the theme and, finally, a field research was carried out in three lots of the Minha Casa Minha Vida program to obtain data about the effectiveness of the analyzed legislation, as a critical evaluation of the standard reality. The development of the present study made it possible to understand the importance of green areas for urban environmental sustainability, as spaces that mitigate the effects of degradation and pollution and where the population can interact with nature, wich also contributes to reach the fundamental right to the environment and to the sustainable city.
