Abstract

This paper addresses current issues and has eminent relevance character, because have asked about a proposal for a fiscal management plan for Santa Maria city. It is intended to contribute to an effective implementation of the Police Power of the municipal inspection activity. This study aimed to verify how the issue of seeking the common good, in detriment of individual rights for the public interest, effectively happens in the legislation and management in Santa Maria. Therefore, were mobilize concepts such as municipal fiscal competence, the applicability of police power and others. Still, it was the deductive method of approach and 5 the bibliographical research procedures in order to verify the relevant issues to the topic in theoretical texts and municipal law of Santa Maria. It was clear that is inherent in the municipality fiscalization duty in the context of local interest, imposing sanctions through the enforceability prerogatives, and by administrative sanctions, which the law requires. It was noted that the disciplinary function when it comes to the existing demand policy, has a particular bias, because recently one lives one of the nation's greatest tragedies, including the lack of zeal in the activity.
