This study proposes to analyze the Brazilian drug policy, focusing especially on the two political models currently applied in the control of these substances in Brazil, represented by the Ministry of Justice and the Ministry of Health. For both, will investigate the historical origins and rationale prohibitionist policy at national and international scene. Are examined, yet, the constitutionality of certain regulations governing matters relating to drugs in the Brazilian legislation. In a second step, analyze drug policy represented by the Ministry of Justice and the Ministry of Health, comparing them with each other and the feasibility of coexistence of both within the same country. Finally, we will study alternative models to Prohibition and the practical implementation of the same in some European countries, in order to verify the possibility of overcoming the current paradigm. For this work we will use the method of deductive approach, and the method of procedure and comparative history.
