Elementos que influenciaram a não aprovação da eleição de diretores na lei que dispõe sobre a gestão democrática no sistema municipal de ensino de Miraguaí/RS

The present study analyzes the Law on Democratic Management of Education, Municipal
Law nº. 1.745/2017, elaborated and approved in 2017. The objective of the research is to
identify the elements that influenced the non-approval of the election of directors in the law
that regulates the democratic management in the municipal education system of Miraguaí /
RS. It consisted of a qualitative research, developed through a case study, whose instrument
of data collection was the semistructured interview and the documentary analysis with
bibliographic support. The results of the research indicate that this law brought in its aspects
administrative, pedagogical and financial management, however, without the forecast of the
election of directors. In the process of drafting the Law, there were no indications of the
participation of the different segments of the school community, previous discussions focused
on the group of teachers, which contributed significantly to this outcome, justified by the
negative experiences of this group with the election of directors in state schools, by involving
political-party issues and disagreements among colleagues. In spite of the peculiarities of the
municipality (small schools, few students and teachers), it is foreseen in Law that the position
of director will be exercised by professional graduated in full degree and will be given to the
Mayor consult collegiate organs. It was concluded that the non-approval of the election of
directors reflected the position of the group of teachers, and it was not possible for the school
community to position itself on the topic "election of directors".
