Formas de combater práticas de dumping social e ambiental: um olhar sob a luz da sustentabilidade nas suas diversas faces

Sustainability and the sustainable development are subjects often approached nowadays due to social problems, the constant climate changes, pollution, and the constant environmental degradation that challenges the survival of life in Earth. Exists, however, the misconception of associating the concept of sustainability only to environmental matters. Such misconception results in a limited and simple view. Sustainability should be understood in all of its facets, subject to the penalty of becoming an unfair and untrue speech. Thereby the business practices of social and environmental dumping face hardly the sustainable search and the sustainable development, prioritizing the voracity and insatiability seek for profit at any cost. Such practices, like it will be showed, generate social damage, reaching the collectivity and are against the maximum principle of sustainability. Starting with the previous concept of sustainability in its various dimensions and the social and environmental practices, it’s possible to analyze the impact generated by these practices in the sustainability dimension. Studying practical cases of the Brazilian jurisprudence it will be verified the effectiveness of the rules and the measures used objecting to emphasize the search and effectiveness of the constitutional principle of sustainability in its various facets.
