dc.description.abstractBased on the terminology used for the construction of the right to one's own image, the author critiques the current state of affairs by proposing the foundations for a new understanding of creating portraits in Chilean law. Thus, if the rights of personality are extra-patrimonial, the right to one's own image does not belong to that category. Moreover, while it can be justified as a fundamental right it should not be considered a subjective public right, but rather as "freedom portrait"
