El desequilibrio procesal y probatorio del “opositor víctima o sujeto vulnerable” en el proceso de restitución de tierras

Abstract

This work is been prepared under the provisions of Victims Act, Law 1448, 2011, and specifically addresses the cases in which arises opposition by a victim, or by a vulnerable subject, considered of special protection, against the claim for restitution of the property by the victim. It does not address the generality of the cases of opposition. Having defined the purpose of the study that concerns, it is necessary to note that this work is focused on investigating the procedural and evidentiary position capabilities of the opposing victim, or vulnerable subject in this type of process, under the aforementioned circumstances, to analyze if the right of this procedural subject to equality is either observed, or violated by the process of land restitution, and which are the alternatives that can be set forth to make the opposing action an instrument to provide a guaranty.
