Protección y tutela de los derechos fundamentales y las libertades públicas en el derecho positivo francés

Abstract

The legal system for protection of the fundamental rights and public liberties in France has significantly evolved with the growing influence of the European system for protection of human rights. Although there are no specific constitutional protection actions in France, there are a wide variety of legal mechanisms intended for providing effective protection of fundamental rights. Furthermore, the European court of Human Rights makes up, in a certain measure, for the lack of constitutional protection. From the description of the French juridical system for protection of human rights we may develop a critical analysis thereof and explain why certain alternative protection instruments have been created.
