dc.description.abstract | This master's thesis focuses on analyzing the principle of publicity as a way to evaluate the confidentiality of defense and national security information. This thesis contains three chapters: the first one develops the phylogenesis of institutions, such as the principle of publicity, rule of law, right of access to public information, information secrecy and democracy. The second focuses on reviewing the justification and criticism of the reservation of defense and national security information in projection of the national interest. The third one proposes an examination of the reservation of public information on defense and national security from the perspective of constitutional jurisprudence. Thus, it is necessary to make a judgment and analysis of the reservation of information, which must start from a study of the exercise of the competence to restrict the information, in order to subsequently determine how valid are the reasons and justifications to restrict the information in a rule of law that should be characterized as democratic, and not only for invoking national interests of survival. | |
