dc.descriptionAtendiendo las necesidades dejadas por las nefastas guerras, es debido precisar que si bien es cierto el Derecho Internacional Humanitario (en adelante DIDH) es un ordenamiento jurídico que busca salvaguardar los Derechos Humanos, del cual hay que resaltar la Carta de San Francisco que contiene la declaración universal de Derechos Humanos y por ser la precursora de las Naciones Unidas, cuya organización ha promovido el Sistema Universal de Protección de los Derechos Humanos, es indudable precisar que el DIDH es la materialización de los diferentes pactos o tratados internacionales, así como la suscripción de otros instrumentos como resoluciones, recomendaciones declaraciones con el propósito de proteger cualquiera de los Derechos Humanos. Por lo tanto, al precisar la existencia de diferentes tratados reconocidos a nivel internacional, como también una estructura y organización de las naciones unidas, se hizo necesario determinar la utilidad de los mecanismos de protección de los Derechos Humanos en el Derecho Internacional, mediante la especificación de cómo los órganos encargados de la protección de los derechos Humanos en el Derecho Internacional, los cuales juegan un papel preponderante en el desarrollo de un sistema normativo supraestatal, garantizándose con ello los derechos inherentes al ser humano, de manera tal que a este ordenamiento le resta tan solo superponerse al ordenamiento jurídico, normativo e interno de cada estado. Haciendo una revisión concienzuda y profunda del ordenamiento mismo se logra identificar que dentro de los procedimientos, existe una consagración a la eficacia, permitiéndose con esto que el acceso a los diferentes medios de defensa de los ciudadanos como sujetos individuales de Derecho sea real y tangible.
dc.descriptionIn response to the needs left by the dire wars, it should be pointed out that, although International Humanitarian Law (IHL) is a legal system that seeks to safeguard human rights, the San Francisco Charter, which contains the Universal Declaration of Human Rights and is the forerunner of the United Nations, should be highlighted, whose organization has been promoted by the Universal System for the Protection of Human Rights, it is clear that the IACHR is the materialization of the different international covenants or treaties, as well as the signing of other instruments such as resolutions, recommendations, declarations with the purpose of protecting any of the human rights. Therefore, when specifying the existence of different internationally recognized treaties, as well as a structure and organization of the United Nations, it became necessary to determine the usefulness of the mechanisms for the protection of human rights in international law, by specifying how the bodies in charge of the protection of human rights in international law play a preponderant role in the development of a supra-state normative system, thus guaranteeing the rights inherent to the human being, in such a way that this system is only superimposed on the legal, normative and internal order of each state. A thorough and profound review of the legal system itself reveals that within the procedures, there is a commitment to efficiency, thus allowing access to the different means of defense of citizens as individual subjects of law to be real and tangible.
