Fundamentos jurídicos para regular el proceso inmediato dentro del ámbito penal militar en los casos del delito de deserción

Abstract

La presente investigación titulada “Fundamentos jurídicos para regular el proceso inmediato dentro del ámbito penal militar en los casos del delito de deserción “. La misma que tuvo como objetivo Determinar cuáles son los fundamentos jurídicos para regular de forma expresa el proceso inmediato dentro del ámbito penal militar en los casos del delito de deserción. La investigación de acuerdo a su orientación es básica, de acuerdo a la técnica de contrastación es descriptica, con un diseño de investigación no experimental. Asimismo, la población y muestra que se utilizó fue a un fiscal y a un juez del fuero Militar Policial de la provincia de Trujillo. Además, de un caso recaído en el expediente fiscal n°0135-2016-01-06 sobre el delito de deserción. Teniendo como técnicas las siguientes: la técnica de la lectura con su instrumento el raciocinio, la técnica de recopilación y análisis documental con su instrumento de guía de análisis documental y la técnica de la entrevista con su instrumento el cuestionario con preguntas debidamente diseñadas para la presente investigación. Ahora bien, con respecto a los métodos, tenemos al deductivo, histórico y hermenéutico. Así, la conclusión es que los fundamentos jurídicos para regular de forma expresan el proceso inmediato dentro del ámbito penal militar en los casos del delito de deserción son: Suficiencia de elementos de convicción en el delito de deserción, necesidad de garantizar justicia eficaz en el ámbito militar, aligeración de carga procesal y la necesidad de mantener la disciplina y la eficiencia en las fuerzas militares

The present investigation entitled ""Legal grounds for regulating the immediate process within the military criminal field in cases of the crime of desertion"". The objective of this research was to determine which are the legal foundations to expressly regulate the immediate process within the military criminal field in cases of desertion. The research according to its orientation is basic, according to the contrast technique it is descriptive, with a non-experimental research design. Likewise, the population and sample used were a prosecutor and a judge of the Military Police Court of the province of Trujillo. In addition, of a case relapsed in the fiscal file n°0135-2016-01-06 on the crime of desertion. Having as techniques the following: the technique of reading with its instrument the reasoning, the technique of documentary collection and analysis with its instrument of documentary analysis guide and the technique of the interview with its instrument the questionnaire with questions duly designed for the present investigation. Now, with respect to the methods, we have the deductive, historical and hermeneutic. Thus, the conclusion is that the legal grounds to expressly regulate the immediate process within the military criminal sphere in cases of the crime of desertion are: Sufficiency of elements of conviction in the crime of desertion, the need to ensure effective justice in the military sphere, lightening of procedural burden and the need to maintain discipline and efficiency in the military forces.
