| dc.description | La pandemia que se produjo por el COVID-19 conllevó a que se tomaran medidas urgentes de protección del derecho a la salud de la población; lo que originó que no se realice un análisis y evaluación suficiente respecto a las medidas que se estaban emitiendo y su relación con los estándares internacionales de protección de dicho derecho. Por ende, en el presente trabajo se busca determinar si el actuar del Perú ante esta crisis es compatible con las obligaciones internacionales que se han asumido. En tal sentido, en el primer capítulo, se determinarán cuáles son las obligaciones internacionales que establecen parámetros de protección para el derecho a la salud, agregándose aquellos mecanismos de exigibilidad que han sido diseñados para tal propósito; ello se hará en virtud del análisis de la normativa del Sistema Interamericano de Derechos Humanos y la jurisprudencia que la Corte Interamericana de Derechos Humanos ha emitido. En el segundo capítulo, se podrá visualizar cómo es que dichas obligaciones se han incorporado en el ordenamiento jurídico peruano empezando por la Constitución Política del Perú, en donde se encontrará la respuesta respecto a cuál es el rol que asume el Estado. Además de exponerse una serie de aspectos trascendentales para el pleno ejercicio del derecho a la salud como el contenido constitucionalmente protegido de dicho derecho y aquellos mecanismos de tutela interna que se han creado en aras de que la persona pueda exigir una actuación o abstención por parte del Estado o terceros que lo vulneren. Tal estudio se realizará teniendo en cuenta el contexto en que se encuentra el sistema de salud y los problemas que el Perú enfrenta para el cumplimiento de sus obligaciones en materia de salud. Una vez analizado el panorama internacional y nacional respecto a la protección del derecho a la salud, podremos identificar cuáles han sido las actuaciones estatales durante la pandemia y si dicho actuar se adecuó a los parámetros de protección que se han desarrollado en los capítulos antes descritos. | |
| dc.description | The pandemic caused by COVID-19 led to the adoption of urgent measures to protect the right to health of the population, which resulted in a lack of analysis and evaluation of the measures that were being issued and their relationship with international standards for the protection of this right. Therefore, this investigation seeks to determine whether Peru's actions in the face of this crisis are compatible with the international obligations it has assumed. In this sense, in the first chapter, the international obligations that establish parameters of protection for the right to health will be determined, adding those mechanisms of enforceability that have been designed for this purpose; this will be done by virtue of the analysis of the regulations of the Inter-American System of Human Rights and the jurisprudence that the Inter-American Court of Human Rights has issued. In the second chapter, it will be possible to visualize how these obligations have been incorporated in the Peruvian legal system, starting with the Political Constitution of Peru, where the answer to the role assumed by the State will be found. In addition to exposing a series of transcendental aspects for the full exercise of the right to health as the constitutionally protected content of this right and those mechanisms of internal protection that have been created so that the person can demand an action or abstention by the State or third parties that violate their right. This study will be carried out taking into account the context in which the health system finds itself and the problems Peru faces in complying with its health obligations. Once the international and national panorama with respect to the protection of the right to health has been analyzed, we will be able to identify the actions of the State during the pandemic and whether such actions were in accordance with the parameters of protection that have been developed in the chapters described above. | |
