dc.description.abstract | La agresión en contra de las mujeres o integrantes del grupo familiar se ha incrementado
alarmantemente en nuestro país y en consecuencia las denuncias presentadas ante las
Comisarias PNP de Familia y Ministerio Público, por lo que en la actualidad se viene
atravesando etapas críticas en la administración de justicia y respecto a la carga procesal en
instituciones del Estado (Ministerio Público y Poder Judicial), siendo ello así llegado el
momento de impartir justicia e iniciar investigación se tiene dificultades en el
cuestionamiento del ordenamiento jurídico psicológico y en la probanza de la afectación
psicológica, cognitiva o conductual en la víctima, puesto que todo acto de violencia familiar
vulnera la integridad física y psicológica del grupo familiar.
El Código Penal considera de manera concreta los tipos de afectación psicológica,
cognitiva o conductual, empero en la praxis jurídica, resulta complejo para el representante
del Ministerio Público imputar una conducta determinada por el daño a la estabilidad
emocional de la parte agraviada, ello debido a que esta afectación que presenta al momento
de ser evaluada pudo haber sido ocasionada por otros agentes en tiempos y espacios
diferentes, por lo resulta cuestionable establecer si la conducta desplegada por el presunto
responsable pudo generar la alteración psicológica que presunta la agraviada, dado el plano
subjetivo de derecho, el asunto reside para los operadores de justicia en el cómo sostener
una imputación y debatir cuestiones psicológicas, toda vez que el tipo penal se basa en
cuestiones subjetivas, mientras que en una investigación fiscal se investiga un hecho
delictivo que tuvo lugar en fecha cierta, en consecuencia resulta difícil tener certeza si la
conducta desplegada por el investigado por el delito que se le sindica, guarda relación con
la afectación psicológica de la agraviada, puesto que al tratarse de un asunto subjetivo
difícilmente se puede llegar a tener un grado de certeza para la emisión de una sentencia
condenatoria.
Entendiéndose que al tipificar esta conducta el legislador no tomo en cuenta el aspecto
emocional de la persona sino más bien los síntomas cognitivos y conductuales para enmarcar
la afectación psicológica; lo que trae como consecuencia dificultad de correlación entre la
norma y la psicología al momento de atribuir responsabilidad al investigado, ante el incremento desmedido de denuncias por violencia familiar específicamente por agresión
física y psicológica, no se puede tener certeza si estos hechos tendrán relación con la
afectación psicológica ya sea cognitiva o conductual que pueda presentar la parte agraviada,
respecto de los hechos atribuidos al imputado; siendo estos elementos necesarios para la
configuración del tipo penal, más aún si las pericias psicológicas no son emitidos de acuerdo
a los parámetros de lineamientos de la Guía para determinar la afectación psicológica,
autorizada por el Instituto de Medicina Legal, que debe servir de manual para cualquier otro
perito. | |
dc.description.abstract | Aggression against women or members of the family group has increased alarmingly in our
country and, consequently, the complaints filed with the PNP Family Commissioners and
the Public Prosecutor's Office, which is why critical stages are currently being experienced
in the administration of justice and with respect to the procedural load in State institutions
(Public Ministry and Judicial Power), this being the case when the time comes to impart
justice and initiate an investigation, there are difficulties in questioning the psychological
legal system and in proving the psychological affectation, cognitive or behavioral in the
victim, since any act of family violence violates the physical and psychological integrity of
the family group.
The Criminal Code specifically considers the types of psychological, cognitive or behavioral
affectation, however in legal praxis, it is complex for the representative of the Public
Ministry to impute a behavior determined by the damage to the emotional stability of the
aggrieved party, due to that this affectation that it presents at the time of being evaluated
could have been caused by other agents in different times and spaces, so it is questionable to
establish whether the conduct displayed by the alleged perpetrator could generate the
psychological alteration that the aggrieved party presumes, given the subjective level of law,
the issue resides for justice operators in how to sustain an accusation and discuss
psychological issues, since the criminal type is based on subjective issues, while in a fiscal
investigation a criminal act that took place on a date is investigated. true, consequently it is
difficult to be certain if the behavior displayed by the person investigated for the crime he is
accused of, is related to the psychological affectation of the victim, since since it is a
subjective matter, it is difficult to have a degree of certainty for the issuance of a conviction.
It is understood that when classifying this behavior, the legislator did not take into account
the emotional aspect of the person, but rather the cognitive and behavioral symptoms to
frame the psychological affectation; which brings as a consequence difficulty of correlation
between the norm and psychology at the time of attributing responsibility to the investigated,
given the disproportionate increase in complaints of family violence specifically for physical
and psychological aggression, it is not possible to be certain if these facts will be related to the psychological affectation, whether cognitive or behavioral, that the aggrieved party may
present, regarding the facts attributed to the accused; these elements being necessary for the
configuration of the criminal type, even more so if the psychological skills are not issued
according to the guidelines parameters of the Guide to determine the psychological
affectation, authorized by the Institute of Legal Medicine, which should serve as a manual
for any other expert. | |
