Criterio judicial para determinar si el alimentista mayor de edad está siguiendo una profesión u oficio exitosamente

Abstract

La presente tesis se titula CRITERIO JUDICIAL PARA DETERMINAR SI EL ALIMENTISTA MAYOR DE EDAD ESTÁ SIGUIENDO UNA PROFESIÓN U OFICIO EXITOSAMENTE, la cual se orienta a identificar cuál es el criterio que tienen los jueces para determinar que el alimentista mayor de edad está siguiendo estudios de una profesión u oficio exitosamente. Por lo cual nos planteamos como problema: ¿Cuál es el criterio que utilizan los jueces, en el proceso de alimentos, para determinar si el alimentista mayor de edad está siguiendo estudios de una profesión u oficio exitosamente? Para comprobar nuestra tesis, analizamos, como muestra, sentencias emitidas en el distrito judicial de Trujillo, Chepén, Chocope y Otuzco, en el marco de los procesos de petición, aumento, reducción y exoneración de alimentos. Esto nos llevó a estudiar la Casación N° 13382004 LORETO. Los métodos que utilizamos fueron Inductivo-Deductivo, Inductivo, Deductivo, Analítico y Sintético; y entre las técnicas utilizamos Acopio Documental, Interpretación Normativa, Fichaje y Estudio de Casos. Finalmente, pudimos cumplir nuestro objetivo, identificando que existen dos elementos comunes que los jueces consideran en la construcción de su criterio, el periodo de tiempo dentro del cual el alimentista viene desarrollando sus estudios y los resultados obtenidos

This thesis is titled JUDICIAL CRITERIA TO DETERMINE IF THE OLDER ALIMENT IS FOLLOWING A PROFESSION OR TRADE SUCCESSFULLY, which is aimed at identifying what is the criterion that the judges have to determine that the obligee of legal age is following studies of a profession or trade successfully. Therefore, we pose as a problem: What is the criterion used by the judges, in the food process, to determine if the legal adult is following studies of a profession or trade successfully? To verify our thesis, we analyzed, as a sample, sentences issued in the judicial district of Trujillo, Chepén, Chocope and Otuzco, within the framework of the petition, increase, reduction and exemption of maintenance processes. This led us to study Cassation N ° 1338-2004 - LORETO.The methods we used were Inductive-Deductive, Inductive, Deductive, Analytical and Synthetic;and among the techniques we use Documentary Collection, Normative Interpretation, Recording and Case Studies. Finally, we were able to fulfill our objective, identifying that there are two common elements that the judges consider in the construction of their criteria, the period of time within which the feeder has been developing his studies and the results obtained.
