El rol del tribunal constitucional en la constitucionalidad de la política peruana

Abstract

El presente trabajo tiene como objetivo analizar el rol y funcionamiento del Tribunal Constitucional peruano en el marco del control del Estado Constitucional de Derecho. Para ello se tendrán en cuenta los principales modelos de control constitucional: difuso, preventivo y concentrado. Se considerará la historia constitucional que da lugar a la necesidad de contar con una entidad de tal magnitud; pese a que en la teoría clásica de la conformación del Estado se configura al Poder Judicial como sede jurisdiccional original. Este trabajo será contextualizado en torno al caso que dio pie a la destitución del Presidente Martín Vizcarra en 2020 y sobre por qué no se llegó a un fallo conclusivo en el fondo.

This work intends to analyze the role and functions of the Peruvian Constitutional Court within the framework of the control of the Constitutional Rule of Law. For this objective, the main models of constitutional control will be considered: diffusive, preventive, and concentrated. The constitutional history that staged the need to have such and entity will be considered as well; even though in the classical theory of the conformation of the State the Judiciary is configured as the original jurisdictional seat. This work will be contextualized around the case which led to the removal of President Martín Vizcarra in 2020 and why a conclusive ruling on the matter was not reached.
