| dc.description | O presente trabalho demonstra as implicações penais que podem surgir do resultado das pesquisas relativas à manipulação genética de embrião humano. Sabe-se que a evolução científica no campo da engenharia genética e técnicas de reprodução humana assistida tem sido responsável por grandes avanços na área da saúde. Entretanto, com o dinamismo em que estão sendo adquiridos tais conhecimentos, surgem necessidade de serem fixados limites e responsabilidades. Neste trabalho, é abordada a temática específica da manipulação genética de embriões humanos, estabelecendo sua correlação com os valores éticos, morais e jurídico-penais. É dada ênfase à necessidade de uma tutela penal acerca do tema, bem como às diversas técnicas de manipulação de embrião humano que podem lesar o patrimônio genético e atentar contra a vida. São desenvolvidas as teorias de maior relevância que tentam definir o momento de inicio da vida, bem como a compatibilização entre os interesses de desenvolvimento tecnológico e a indispensável proteção do ser humano. Na busca da legislação adequada, capaz de incentivar as pesquisas e, ao mesmo tempo, impedir abusos, são analisadas as lacunas existentes no ordenamento jurídico-penal no que tange à proteção do embrião, bem com demonstra-se a urgente necessidade da legislação que seja efetiva na proteção do direito à vida e a intangibilidade e inalterabilidade do patrimônio genético, apontando possíveis caminhos para a devida tipificação e responsabilização jurídico-penal dos desvios | |
| dc.description | This article discusses the criminal implications that may arise from the results of research on the genetic manipulation of the human embryo. It is known that the scientific developments in the field of genetic engineering and assisted reproduction techniques has been responsible for major breakthroughs in healthcare. However, the dynamism that is being acquired such knowledge arise needs to be fixed boundaries and responsibilities. In this paper, we addressed the specific theme of genetic manipulation of human embryos, establishing its correlation with the ethical, moral, legal and criminal. It is intended to emphasize the need for a criminal oversight on the subject as well as the various techniques for manipulating human embryo that can damage the genetic heritage and attacking the living. It will highlight the most relevant theories that attempt to define the moment of the beginning of life as well as the challenge of achieving compatibility between the interests of technological development and the necessary protection of the human being. In search of appropriate legislation, able to encourage research and at the same time prevent abuse, we intend to analyze the gaps in the legal - criminal in regard to the protection of the embryo, as well as demonstrate the urgent need for legislation that is effective in protecting the right to life and to inviolability and inviolability of genetic heritage, pointing possible paths for proper classification and criminal legal accountability of deviations | |
