| dc.description | Introduction: This article is directed towards the problem of murder and the consummation of the right to life through the accelerated rate of violent deaths in Ecuador. Objective: The legal and social aspects related to these crimes are analyzed, as well as the repercussions on Ecuadorian society. Updated statistics are presented and viable solutions to address this severe problem are explored. Methodology: The scientific article is based on a quantitative and descriptive approach, using historical, dogmatic, analytical, and synthetic methods; by obtaining information and data through an interview with the Provincial Prosecutor of Cañar. Finally, the creation of public policies is proposed, such as stricter immigration controls, criminal background checks, the positive reinsertion of convicted persons through education programs in rehabilitation centers and the creation of sources of employment for those deprived of liberty. Results: The importance of guaranteeing the right to life as a fundamental pillar of democratic society is highlighted. A reform to article 158 of the Constitution of the Republic of Ecuador is suggested, to strengthen security controls with the intervention of the Armed Forces, as well as to toughen the penalty established in article 140 of the Organic Integral Penal Code from 30 to 35 years of deprivation of liberty. | en-US |
| dc.description | Introducción: Este artículo se direcciona hacia la problemática del asesinato y la consumación del derecho a la vida a través del acelerado índice de muertes violentas en el Ecuador. Objetivo: Se analizan los aspectos legales y sociales relacionados con estos delitos, así como las repercusiones en la sociedad ecuatoriana. Se presentan estadísticas actualizadas y se exploran posibles soluciones para abordar este grave problema. Metodología: El artículo científico se fundamenta en un enfoque cuantitativo y descriptivo, utilizando métodos históricos, dogmáticos, analíticos y sintéticos; mediante la obtención de información y datos por intermedio de la entrevista al Fiscal Provincial de Cañar. Finalmente, se propone la creación de políticas públicas, como controles migratorios más estrictos, revisión de antecedentes penales, la reinserción positiva de los sentenciados a través de programas de educación en los centros de rehabilitación y la creación de fuentes de empleo para los privados de la libertad. Resultados: Se destaca la importancia de garantizar el derecho a la vida como un pilar fundamental de la sociedad democrática. Se sugiere una posible reforma al artículo 158 de la Constitución de la República del Ecuador, para fortalecer los controles de seguridad con la intervención de las Fuerzas Armadas, así mismo endurecer la pena tipificada en el artículo 140 del Código Orgánico Integral Penal de 30 a 35 años de privación de la libertad.
