| dc.description | In this work, it was analyzed how the extemporaneous presentation or the lack of presentation of the psychological assessment reports within the term of the investigative phase in the misconduct of this nature that is processed in the Prosecutor's Office of the Province of Cañar, violates constitutional rights. legal certainty and effective judicial protection of the victim. It has been possible to determine the importance of following up on the victims of this type of violence to somehow mitigate this problem that is currently notorious in the country. Through the application of the mixed approach: qualitative and quantitative, with a descriptive level of depth and the use of inductive and deductive, analytical, and synthetic methods, and the legal dogmatic, the reasons attributed to the breach and the repercussion are analyzed. that it has on the legal situation of the victim according to a conceptual framework of the constitutional rights mentioned above. | dc.description | En este trabajo se analizó, cómo la presentación extemporánea o la falta de presentación de los informes de valoración sicológica dentro del plazo de la fase investigativa en las inconductas de esta naturaleza que se tramitan en la Fiscalía de la Provincia del Cañar vulnera los derechos constitucionales a la seguridad jurídica y a la tutela judicial efectiva de la víctima. Se ha logrado determinar la importancia de darle seguimiento a las víctimas de este tipo de violencia con la finalidad de mitigar de alguna forma este problema que es notorio en la actualidad en el país. A través de la aplicación del enfoque mixto: cualitativo y cuantitativo, con un nivel de profundidad descriptivo y la utilización de los métodos inductivo y deductivo, analítico y sintético, y el dogmático jurídico se analiza los motivos que se atribuyen al mencionado incumplimiento y la repercusión que tiene sobre la situación jurídica de la víctima conforme a un marco conceptual de los derechos constitucionales mencionados con anterioridad. Con base en el análisis desarrollado, se proponen criterios generales para superar el problema identificado. | es-ES |
