| dc.description | Desde la aprobación en el año 2019 de la nueva Constitución de la República de Cuba, luego de un amplio debate con el pueblo, y por mando de la decimotercera disposición transitoria de la propia carta magna, la Asamblea Nacional del Poder Popular, aprobó un cronograma legislativo que garantiza el desarrollo de los preceptos establecidos en la Carta Magna. Dentro de los cuerpos legales aprobados en el cumplimiento de este mandato constitucional, se ubica la Ley del Proceso Penal y la Ley del Proceso Penal Militar, las cuales, como parte de sus novedades, regulan con un mayor rigor científico y jurídico las acciones de instrucción denominadas reconstrucción de los hechos y experimento de instrucción. Esta investigación tiene como objetivo mostrar los avances alcanzados en la instrumentación legal de las acciones de instrucción de referencia en la República de Cuba. Para alcanzar el objetivo previsto se emplearon los métodos histórico-lógico, teórico jurídico y el exegético, y las técnicas de investigación análisis de documentos. Se comprueban los aportes de las nuevas leyes, en el orden científico, jurídico y metodológico a la compresión y aplicación de la reconstrucción de los hechos y el experimento de instrucción y la garantía que ello proporciona en función de alcanzar una mayor coherencia y seguridad jurídica, como elementos imprescindibles para el fortalecimiento del Estado de Derecho. | es |
| dc.description | Since the approval in 2019 of the new Constitution of the Republic of Cuba, after a broad debate with the people, and by command of the thirteenth transitory provision of the Magna Carta itself, the National Assembly of People's Power approved a legislative schedule that guarantees the development of the precepts established in the Magna Carta. Among the legal bodies approved in compliance with this constitutional mandate are the Criminal Procedure Law and the Military Criminal Procedure Law, which, as part of their novelties, regulate with greater scientific and legal rigor the investigative actions known as reconstruction of the facts and investigative experiment. The objective of this research is to show the advances achieved in the legal instrumentation of the actions of instruction of reference in the Republic of Cuba. In order to reach the foreseen objective, the historical-logical, legal-theoretical and exegetical methods were used, as well as the research techniques document analysis. The contributions of the new laws, in the scientific, legal and methodological order, to the understanding and application of the reconstruction of facts and the investigation experiment and the guarantee that this provides in terms of achieving greater coherence and legal certainty, as essential elements for strengthening the rule of law. | en |
