| dc.description | Las iniciativas mundiales en cuanto a la protección del ambiente, motivaron a la mayoría los países del mundo a actualizar su marco jurídico mediante la suscripción de Tratados y Convenios Internacionales y redactar leyes ambientales. En Honduras se redactó en el año de 1993 la Ley General de Medio Ambiente, como ente rector de la protección del medio ambiente, más, otras leyes que vinieron a complementar la protección de los recursos naturales, la flora y la fauna de Honduras. Esta investigación se centró en recopilar del Código Penal Decreto 130-2017, los delitos y faltas ambientales, analizar cada artículo, exponiéndolo como las nuevas herramientas en la defensa legal del medio ambiente y que permita conocer su funcionalidad dentro del marco jurídico del Derecho Penal. También se extrajo parte de la Ley General del ambiente y de la Constitución Política de 1982, como marco de apoyo a la investigación. El marco teórico inicia poniendo en contexto al lector con nociones sobre la responsabilidad penal, conduciendo ésta parte de la investigación, por una serie de definiciones y conceptos que lo introduzcan al conocimiento de cómo actúa y en que se fundamenta el delito, para lograr que su aplicabilidad funcione como una herramienta que lleve al profesional del derecho a resolver los casos concretos que se presenten.De países como Ecuador, Colombia y España, se reunieron los artículos mayormente relacionados, de sus Constituciones Políticas, del Código Penal y de sus Códigos Ambientales, con la protección del medio ambiente y el derecho a vivir en un ambiente sano. Al final se presentó un análisis comparativo, resaltando las diferencias y similitudes que cada nación tiene con nuestro país Honduras, las oportunidades que todavía se tiene para fomentar un mayor compromiso en la tutela del ambiente en Honduras y poner nuestra legislación ambiental en similitud y posterior mejora de estos países. | |
| dc.description | Global initiatives regarding the protection of the environment motivated the majority of the countries of the world to update their legal framework by signing International Treaties and Conventions and drafting environmental laws. In Honduras, the General Environmental Law was drafted in 1993, as the governing body for the protection of the environment, plus other laws that came to complement the protection of natural resources, flora and fauna of Honduras. This research focused on compiling the Criminal Code Decree 130-2017, environmental crimes and offenses, analyzing each article, exposing it as the new tools in the legal defense of the environment and allowing knowing its functionality within the legal framework of Criminal Law. Part of the General Law of the environment and the Political Constitution of 1982 was also extracted, as a framework to support the investigation. The theoretical framework begins by putting the reader in context with notions about criminal responsibility, conducting this part of the investigation, through a series of definitions and concepts that introduce him to the knowledge of how he acts and on which the crime is based, to ensure that his applicability functions as a tool that leads the legal professional to resolve the specific cases that arise. From countries such as Ecuador, Colombia and Spain, the articles mostly related to their Political Constitutions, the Penal Code and their Environmental Codes, with the protection of the environment and the right to live in a healthy environment, were gathered. At the end, a comparative analysis was presented, highlighting the differences and similarities that each nation has with our country Honduras, the opportunities that still exist to promote a greater commitment to protect the environment in Honduras and put our environmental legislation in similarity and subsequent improvement of these countries. | |
