dc.descriptionThis research had as general objective the study of the methodology currently used by public agencies for the investigation of aeronautical accidents within the Brazilian territory and the legal reflections of these investigations. The purpose of the present paper is to present the current Brazilian research scenario regarding aeronautical accidents, demonstrating the shortcomings contained in the Organizational Factor used, as well as suggesting solutions to the problem. It is characterized as a research developed based on bibliographical studies the digital and print collection, historical analysis comparative with the methodology and applied standards in the investigations to accidents, aeronautical incidents and occurrences in ground occurred abroad, as well as interview with three professionals specialized in the aerial The research has a qualitative character, that is, it seeks to evaluate the degree of efficiency of the methodology used in the investigations. At the end of the research, it is concluded that the preventive methodology currently applied to aeronautical accident investigations in Brazil demonstrates a low level of efficiency of the public agencies in the search for the determining causes of the aeronautical accident, putting at risk the safety of the flight. The work awakens the critical sense of the members of the aeronautical community regarding the current Brazilian investigative procedure, allowing the discussion about the degree of efficiency of the related Organizational Factors.
dc.descriptionEsta pesquisa teve como objetivo geral o estudo da metodologia atualmente utilizada pelos órgãos públicos para a investigação de acidentes aeronáuticos no âmbito do território brasileiro e os reflexos jurídicos destas investigações. A função do presente trabalho é a apresentação do atual cenário investigativo brasileiro no que concerne aos acidentes aeronáuticos, demonstrando as deficiências contidas no Fator Organizacional utilizado, bem como sugerindo soluções à problemática. Caracteriza-se como uma pesquisa desenvolvida com base em estudos bibliográficos a acervo digital e impresso, análise histórica comparativa com a metodologia e normas aplicadas nas investigações a acidentes, incidentes aeronáuticos e ocorrências em solo ocorridos no exterior, bem como entrevista com três profissionais especializados na aérea. A pesquisa possui caráter qualitativo, isto é, busca avaliar o grau de eficiência da metodologia utilizada nas investigações. Ao finalizar a pesquisa, conclui-se que a metodologia preventiva atualmente aplicada às investigações de acidentes aeronáuticos no Brasil demonstra baixo grau de eficiência dos órgãos públicos na busca pelas causas determinantes do acidente aeronáutico, colocando em risco a segurança do voo. O trabalho desperta o senso crítico dos integrantes da comunidade aeronáutica no que tange ao atual procedimento investigatório brasileiro, possibilitando a discussão acerca do grau de eficiência dos Fatores Organizacionais relacionados.
