| dc.description | O presente artigo científico utiliza-se do método dedutivo, qualitativo e descritivo. Assim, esse trabalho científico busca estudar sobre a efetividade da tutela prestada pelo Código de Proteção e Defesa do Consumidor no comércio eletrônico, sob a luz da ferramenta do Diálogo das Fontes. Com esse intuito, destacar-se-á o papel primordial do Direito do Consumidor na promoção da harmonia social através da compensação das disparidades existentes entre ambos os polos da relação de consumo. Nesse sentido, ressaltar-se-á o papel do Direito do Consumidor em satisfazer a função social constitucional. Ademais, será evidenciada a problemática da lacuna temática existente no CDC sobre o e-commerce frente às práticas abusivas que emergem do contexto de comércio virtual. Além disso, o artigo fará um breve estudo de caso do PL n° 3514/15 em trâmite na Câmara dos Deputados. Consequentemente, examinar-se-á se o diálogo entre as diferentes fontes consumeristas poderá tutelar de forma satisfatória os direitos do consumidor vulnerável. | |
| dc.description | This scientific work uses the deductive, qualitative and descriptive method. Thus, this scientific work seeks to study the effectiveness of the protection provided by the Consumer Protection and Defense Code in electronic commerce, in the light of the Source Dialog tool. To this end, the primary role of Consumer Law will be highlighted in promoting social harmony through the compensation of existing disparities between both poles of the consumer relationship. In this sense, the role of Consumer Law in satisfying the constitutional social function will be highlighted. In addition, the problem of the thematic gap existing in CDC about e-commerce will be highlighted in the face of abusive practices that emerge from the context of virtual commerce. In addition, the work will make a brief case study of PL No. 3514/15 pending in the Chamber of Deputies. Consequently, it will be examined whether the dialogue between the different consumerist sources can satisfactorily protect the rights of the vulnerable consumer. | |
