| dc.description | This paper aims to analyze the application of emergency protective measures by Police Chief, highlighting the law n. 13.827/19, compared to the law n. 11.340/06, better known as Maria da Penha law. It sought to clarify the functions of the Civil Police and their agents, giving greater importance to the position of Police Delegate. It also sought to display the history of the Maria da Penha Law, as well as the concepts of the forms of family domestic violence, the functioning of the granting of the previous urgent protective measures to law n. 13.827/06, as well as subsequent to that law. Finally, it analyzed the reflexes of the Maria da Penha Law update in the current context, as well as the criticisms and benefits that the law n. 13.827/06 brought. During the studies it was found that the Maria da Penha Law needs further updates to better guarantee the rights of women, who are still vulnerable. | |
| dc.description | O presente trabalho tem por objetivo analisar a aplicação das medidas protetivas de urgência por Delegado de Polícia, com destaque para a Lei n. 13.827/19, em comparativo com a Lei n. 11.340/06, mais conhecida como Lei Maria da Penha. Procurou esclarecer as funções da Polícia Civil e de seus Agentes, dando maior importância ao cargo de Delegado de Polícia. Buscou, ainda, exibir o histórico da Lei Maria da Penha, bem como os conceitos das formas de violência doméstica familiar, o funcionamento da concessão das medidas protetivas de urgência anterior à Lei n. 13.827/06, assim como ulterior à referida lei. Por fim, analisou os reflexos da atualização da Lei Maria da Penha no contexto atual, tal como as criticas e benefícios que a Lei n. 13.827/06 trouxe. No decorrer dos estudos verificou-se que a Lei Maria da Penha precisa de novas atualizações para melhor garantir os Direitos das mulheres, as quais ainda estão vulneráveis. | |
