dc.descriptionNo presente artigo pretende-se analisar o direito à privacidade enquanto direito individual e inerente à personalidade da pessoa humana, analisando a evolução histórica deste direito no mundialmente e seu desenvolvimento no ordenamento jurídico brasileiro, bem como sua proteção e eficácia. Além do olhar histórico, busca-se a análise do conceito de direito à privacidade, considerando o cenário da pós-modernidade e novas tecnologias, visando abranger referido conceito de modo a entender se a atual a legislação é capaz de efetivamente assegurar referida proteção ao direito à privacidade da pessoa natural de forma efetiva, bem como o papel das novas tecnologias neste cenário e sua capacidade de interferir neste direito.
dc.descriptionThis article aims to analyze the right to privacy as an individual right inherent to the personality of the human person, analyzing the evolution of this right worldwide and its development in the Brazilian legal system, as well as its protection and effectiveness. Beyond the historical look, we seek to analyze the concept of right to privacy, considering the scenario of postmodernity and new technologies, aiming to cover this concept of in order to understand whether the current legislation is capable of effectively ensuring such protection of the right to privacy of the natural person effectively as well as the role of new technologies in this scenario and their ability to interfere in this right.
