| dc.description | In view of the influence of Canon Law in the civil sphere of the Brazilian legal system, research on the legal processing of matrimonial nullity and its possible effects on the Brazilian civil jurisdiction, in order to analyze the possible civil effects of religious marriage and ecclesiastical sentence of matrimonial nullity for the civil sphere. For this, it is necessary to understand the concepts of civil and religious marriage, the similarities and peculiarities, as well as the formation of ecclesiastical courts and the forms of judicial processing of nullity of marriage by the Catholic Church. Then, a bibliographic and documentary research is carried out on the subject under study. That said, the possibility of obtaining civil effects to civil marriage is verified, as well as the ratification of ecclesiastical sentences of matrimonial nullity by the Superior Court of Justice. | |
| dc.description | Tendo em vista a influência do Direito Canônico na esfera civil do ordenamento jurídico brasileiro, pesquisou-se sobre o processamento judicial de nulidade matrimonial e seus possíveis efeitos na jurisdição civil brasileira, a fim de analisar os possíveis efeitos civis do casamento religioso e da sentença eclesiástica de nulidade matrimonial para o âmbito civil. Para tanto, foi necessário compreender os conceitos do casamento civil e religioso, as semelhanças e particularidades, bem como a formação dos tribunais eclesiásticos e as formas de processamento judicial de nulidade do matrimônio pela Igreja Católica. Realizou-se, então, uma pesquisa bibliográfica e documental acerca da temática em estudo. Diante disso, verificou-se a possibilidade da obtenção de efeitos civis ao casamento religioso, bem como de homologação das sentenças eclesiásticas de nulidade matrimonial pelo Superior Tribunal de Justiça. | |
