| dc.description | The study aims to understand what the basic principles of the Consumer Protection Code and the Federal Constitution will be offended by the effective enactment of Bill nº. 34/2015, which exempts the use of the indicative symbol proving the presence of transgenic components on food labels. The type of research, in terms of level, was exploratory and, regarding the approach, the qualitative one was used. The procedure used for data collection was bibliographic. The results showed that the principles of prevention, precaution and reversal of the burden of proof will be met deadly if PL no. 34/2015 be promulgated. The conclusions obtained pointed that the promulgation of PL no. 34/2015, should not occur, given the legal instability and the seriousness of the possible problems that such promulgation may cause in the future. | |
| dc.description | O estudo tem o objetivo de compreender quais os princípios básicos do Código de Defesa do Consumidor e da Constituição Federal serão ofendidos com a efetiva promulgação do Projeto de Lei nº. 34/2015, que desobriga a utilização do símbolo indicativo comprovando a presença de componentes transgênicos nos rótulos dos alimentos. O tipo de pesquisa, quanto ao nível, foi exploratória e, no tocante à abordagem, utilizou-se a qualitativa. O procedimento utilizado à coleta de dados foi o bibliográfico. Os resultados alcançados evidenciaram que os princípios da prevenção, precaução e da inversão do ônus da prova serão atingidos mortalmente caso o PL nº. 34/2015 seja promulgado. As conclusões obtidas apontaram no sentido de que a promulgação do PL nº. 34/2015, não deve ocorrer, visto a instabilidade jurídica e a gravidade dos possíveis problemas que futuramente tal promulgação poderá vir a acarretar. | |
