dc.descriptionNeste trabalho serão abordados os aspectos históricos e conceitos dos crimes ci-bernéticos, bem como algumas noções gerais de cibercriminalidade, sua evolução e uma breve explanação das atuais leis brasileiras que tratam do tema, as facilidades do ambiente virtual, tendo em vista o anonimato, tornaram essa ferramenta um meio propício para atos criminosos uma vez que se camuflar na internet se torna fácil, tor-nando assim cabível elucidar quais os impactos jurídicos dos crimes virtuais, e quais instrumentos legais podem ser considerados no julgamento dos mesmos. Desse modo, este estudo teve por objetivo investigar a aplicabilidade da legislação brasileira contra os crimes cibernéticos e sua evolução não obstante o enfoque da pesquisa é um estudo aprofundado do exercício do direito à liberdade de expressão e a fim de se determinar os limites ao exercício desse direito na internet, como as repercussões dos ataques à honra e à imagem de um indivíduo através desse meio de comunicação globalizada, haja vista a frequência com que esses tipos de crimes vêm sendo cometidos, sobretudo no momento mais atual de crise sanitária vivenci-ada pelo mundo decorrente da pandemia do novo coronavírus(COVID-19), e que por conta das medidas restritivas impostas de isolamento social, deixaram os indivíduos mais dependentes das ferramentas digitais e consequentemente mais vulneráveis a esses crimes. Torna-se fundamental preencher as lacunas normativas, diminuindo a impunidade e garantindo um ambiente de segurança aos usuários.
dc.descriptionIn this work, the historical aspects and concepts of cyber crimes will be approached, as well as some general notions of cybercriminality, its evolution and a brief expla-nation of the current Brazilian laws that deal with the subject, the facilities of the vir-tual environment, in view of the anonymity, made this tool a conducive means for criminal acts since camouflage on the internet becomes easy, thus making it possi-ble to elucidate the legal impacts of virtual crimes, and which legal instruments can be considered in their judgment. Thus, this study aimed to investigate the applicabi-lity of Brazilian legislation against cybercrime and its evolution, despite the focus of the research being an in-depth study of the exercise of the right to freedom of ex-pression and in order to determine the limits to the exercise of this rights on the in-ternet, such as the repercussions of attacks on the honor and image of an individual through this globalized means of communication, given the frequency with which these types of crimes have been committed, especially in the most current moment of the health crisis experienced by the world as a result of of the new coronavirus pandemic (COVID-19), and that due to the restrictive measures imposed for social isolation, left individuals more dependent on digital tools and consequently more vulnerable to these crimes. It is essential to fill regulatory gaps, reducing impunity and ensuring a safe environment for users.
