| dc.description | The present work deals with the divergence as to the attribution for the investigation of
the intentional crimes practiced by military police against civilians, raising questions as
to the investigation to occur through military police investigation, presided by Official,
or if the investigation would be done by means of a common police inquiry, Chaired by
Police Commissioner, or whether both investigations could coexist. The work includes
the study and definition of the attribution to determine such crimes, including the
analysis of the changes introduced by Law 9.299 / 96 and Constitutional Amendment
45/2004 and classification of crime as common or military. Concluding on the need to
build a pacified and fair understanding among the organs, disciplining the form of action
in the case under study. | |
| dc.description | O presente trabalho versa sobre a divergência quanto a atribuição para apuração dos
crimes dolosos praticados por policiais militares contra civis, levantando questões
quanto a investigação ocorrer através de inquérito policial militar, presidido por Oficial,
ou se a apuração se daria por meio de inquérito policial comum, presidido por
Delegado de Polícia, ou ainda se ambos os inquéritos poderiam coexistir. O trabalho
abrange o estudo e definição da atribuição para apuração de tais delitos, passando
pela análise das mudanças introduzidas da Lei 9.299 /96 e Emenda Constitucional 45
/2004 e classificação do crime como comum ou militar. Concluindo pela necessidade
da construção de um entendimento pacificado e justo entre os órgãos, disciplinando a
forma de atuação no caso em estudo. | |
