| dc.description | Everyday, the internet’s expansion is bigger and uncontrollable, this fact make a new part of Law is born. This arises from the various legal relationships present in the digital environment. The network, made up of a broad and difficult regulatory environment, make it easy the expansion of cybercrime. The work aims to analyze the crime of non-consensual sharing of intimate images, popularly known as Revenge Porn. This article also includes a brief study of cases related to the subject, as well as the understanding of this new modality as a gender violence. Finally, a survey is made on how the legal system of other countries deal with the issue and how Brazil has been dealing with this crime over the years. Faced with the lack of a specific norm, it becomes clear the need to criminalize pornography of revenge, so that the State can act effectively in the fight against this new cyber crime. | |
| dc.description | Com a expansão da internet nasce um novo ramo do Direito, que surge das diversas relações jurídicas presentes no ambiente digital. A rede, composta por um ambiente amplo e de difícil regulamentação, facilita o surgimento e expansão dos crimes cibernéticos. O trabalho tem como propósito analisar o crime de compartilhamento não consentido de imagens íntimas, popularmente conhecido por Revenge Porn. Cabe também ao presente artigo um breve estudo de casos referentes ao tema, bem como o entendimento desta nova modalidade como uma violência de gênero. Por fim, é feito um levantamento sobre como o Ordenamento Jurídico de outros países lidam com o tema e como o Brasil vem tratando deste crime com o passar dos anos. Diante da carência de uma norma específica, torna-se clara a necessidade de criminalizar a pornografia de vingança, para que o Estado possa atuar de forma eficaz no combate a este novo crime cibernético. | |
