| dc.description | The present work aimed to analyze the equalization between reasonable
duration of the process and respect for fundamental guarantees. Thus, it was analyzed the
stigma that the criminally accused suffers from the delay in the conduct of the criminal
process, through the Social Labeling Theory, and how this can transform the process into
the penalty itself. Subsequently, the structural racism that constitutes the Brazilian
Criminal Law was explored, and the repercussions on the penal system, related to the
aforementioned theory. Thus, the stigma of the accused is aggravated by a process that
extends over time, and in the Brazilian context there is a reality of process congestion,
and there is no maximum forecast for the duration of the process, demonstrating the need
to fulfill this normative gap. It is intended, then, to critically analyze, based on previously
selected and qualitatively treated bibliography, how the criminal process can interfere
with the stigma of the accused, and how this is aggravated by a process that is excessively
prolonged in time. | |
| dc.description | O presente trabalho objetivou uma análise da equalização entre duração
razoável do processo e o respeito das garantias fundamentais. Dessa forma, foi analisado
o estigma que o acusado criminalmente sofre com a demora do desenrolar do processo
penal, por meio da Teoria do Etiquetamento Social, e como isso pode transformar o
processo na própria pena. Posteriormente foi explorado o racismo estrutural constituinte
do Direito Penal brasileiro, e as repercussões no sistema penal, relacionado com a
mencionada teoria. Assim, o estigma do acusado é agravado por um processo que se
prolonga no tempo, e no contexto brasileiro tem-se uma realidade de congestionamentos
dos processos, e de não haver uma previsão máxima para a duração do processo,
demonstrando a necessidade de preencher essa lacuna normativa. Pretende-se então,
analisar criticamente, com base em bibliografia previamente selecionada e
qualitativamente tratada, como o processo penal pode interferir no estigma do acusado, e
como isso se agrava com em processo que se prolonga excessivamente no tempo. | |
