dc.descriptionThis study proposes to realize an analysis of the phenomenon known as judicialization of health care, considered as the growing number of demands taken to judicial review when the applicant pleads the supply through the Government of some installment related to the health care rights. This study will focus primarily on cases involving the provision of judicial high-cost medications for the treatment of cancer patients, seeking to demonstrate the essentiality of judicial intervention against the omission State, the only way to ensure the full realization of the fundamental rights to healthy and to life enshrined in the Federal Constitution of 1988.
dc.descriptionEste trabalho se propõe a realizar uma análise do fenômeno conhecido como judicialização da saúde, considerado como o crescente número de demandas levadas ao judiciário em que se pretende a concessão pelo Estado de determinada prestação ligada à garantia do direito fundamental à saúde. O presente estudo focará principalmente nos casos que envolvam o fornecimento judicial de medicamentos de alto custo destinados ao tratamento de pacientes com câncer, buscando-se demonstrar a essencialidade da intervenção judicial frente à omissão Estatal, sendo a única forma de garantir a plena realização dos direitos fundamentais à saúde e à vida insculpidos na Constituição Federal de 1988.
