| dc.description | Cases that are highly visible in the media, for having elements considered interesting for the construction of a story, usually present an investigative walk hampered by social pressure generated by such repercussions. These losses can be caused by the loss of evidence, undue accusation, inefficiency, among several others consequences that will be dealt with in the work progress. In addition, the strong presence of the media in the investigations puts the fundamental rights of those investigated in conflict, such as the inviolability of image, honor, privacy and presumption of innocence, with the guarantees given by the Federal Constitution to the press, such as freedom of expression, thought and information.
For society to function democratically with all rights respected to the best possible extent, parameters must be established so that this relationship between media and criminal law exists without further losses. In the present work, the study on the rights of each sector will be in depth, in order to finally present suggestions that balance the performance of the media with respect for the rights of those involved. | |
| dc.description | Casos que são de grande visibilidade midiática, por possuírem elementos considerados
interessantes para a construção de uma história, costumam apresentar uma caminhada
investigativa prejudicada por conta da pressão social gerada por tamanha repercussão.
Esses prejuízos podem se dar na perda de provas, na acusação indevida, ineficiência, entre
vários outros que serão tratados no percurso do trabalho. Além disso, a forte presença da
mídia no andamento das investigações põe em conflito os direitos fundamentais dos investigados, como a inviolabilidade da imagem, honra, privacidade e presunção de inocência, e as garantias dadas pela Constituição Federal à imprensa, como a liberdade de expressão,
pensamento e informação.
Para que a sociedade possa funcionar democraticamente com todos os direitos respeitados na melhor medida possível, parâmetros devem ser estabelecidos para que essa
relação entre mídia e direito penal exista sem maiores prejuízos. No presente trabalho, o
estudo sobre os direitos de cada setor será aprofundado, para ao final apresentar sugestões
que equilibrem a atuação da mídia com o respeito aos direitos dos envolvidos. | |
