| dc.description | Dedica-se este trabalho ao questionamento dos limites da intervenção do Estado nos direitos dos povos indígenas no que concerne à regulação do acesso e repartição dos conhecimentos tradicionais associados à biodiversidade. Pretende inicialmente tratar da propriedade imaterial indígena e do conhecimento tradicional associado como espécie daquela, de modo a destacar a relevância, bem como, as peculiaridades que decorrem da natureza deste saber. Será analisado o contexto histórico para a regulamentação internacional e interna sobre o acesso e a exploração de recursos naturais e conhecimentos tradicionais a eles associados, também o uso irregular e fraudulento que sucedeu ao longo da história. Como problema central do trabalho destacar-se-á o advento da Lei 13.123/15, a qual alterou os requisitos para o acesso ao conhecimento tradicional associado de forma a desburocratiza-lo, restringiu à apenas uma hipótese a repartição de benefícios pela criação de um produto a partir do conhecimento de comunidades tradicionais e a delimitou em valores regulados pela lei, por fim, será averiguado o processo para a criação da lei em comento e a participação dos povos titulares de direitos. | |
| dc.description | This work is dedicated to question the limits of State Intervention in the indigenous rights, specifically it concerns about the regulation in the access and distribution of traditional associated knowledge to biodiversity. At the beginning, it intends to discuss the indigenous intellectual property and the traditional associated knowledge, as well as its peculiarities accrue of the nature of this form of knowledge. Then it will analyze the historic context of the international and national regulamentation about the access and exploitation of natural resources e traditional knowledge associated to them and the irregular and fraudulent use that happened over the history. It is posed as the central problem of this paper to highlight the advent of the Law 13.123/15 that altered the requisites for the access of this knowledge in order to debureaucratize it, restricting to only one possibility of distribution of the benefits by the creation of a product that has the knowledge of these communities as the initial basis and limited it to regulated values by the law. In the end, it will be checked if the process of creation of this law and participation of the rightful people. | |
