| dc.description | O presente trabalho trata do ativismo judicial e a possibilidade de o Poder Judiciário impor a realização de obras no presídio central de Porto alegre, tendo em vistas dificuldades financeiras que estão presentes na realidade brasileira. O princípio da dignidade da pessoa humana apresenta-se como principal argumento para realização de reforma em presídios, bem como a máxima efetividade da Constituição, tendo em vista a situação precária em que os detentos se encontram. Em sentido contrário, a separação de poderes fundamenta a impossibilidade de intervenção do Poder Judiciário em matéria reservada à Administração Pública, juntamente com a falta de verba orçamentária. Assim, a tensão entre as duas correntes será o ponto principal de discussão deste trabalho. | |
| dc.description | This study deals with the judicial activism and the ability of the Judiciary to impose the execution of works in the central prison of Porto Alegre, in view financial difficulties that are present in the Brazilian reality. The principle of human dignity is presented as the main argument for carrying out reform in prisons, and the maximum effectiveness of the Constitution in view the precarious situation. On the other hand, the separation of powers underlying the intervention inability of the judiciary in matters reserved for Public Administration, along with the lack of budget funds. Thus, the tension between the two currents will be the main point discussion of this study. | |
