dc.descriptionRealizada em Haia em outubro do ano de 1980, a Convenção de Haia sobre os Aspectos Civis do Sequestro Internacional de Criança é um instrumento de Direito Internacional Privado que tem o objetivo de que seja restabelecido o status quo que vigia anterior à remoção ou à retenção ilegal da criança, e determina que a criança seja imediatamente retornada ao local em que residia com habitualidade. A lei que se aplica para dirimir as questões decorrentes de guarda, acesso e visitação é a lei do foro do local onde a criança residia, conforme determina a Convenção. Porém defende-se que essa predeterminação do foro pode não atender ao melhor interesse da criança, pois em algumas situações a lei do foro possa não ter acompanhado as transformações dos Direitos Humanos reconhecidos globalmente. Diante disso, uma solução que pode ser aplicada até mesmo entre países não signatários da Convenção de que aqui se trata, é a utilização de meios alternativos extrajudiciais de solução de conflitos. Dentre eles, a mediação de mostra como a melhor opção, uma vez que ela humaniza o processo, por trazer novamente o foco dentro da relação com elemento internacional para as pessoas envolvidas e, também, por permitir que as próprias partes alcancem um acordo nos seus termos evitando futuramente, que novos conflitos emerjam entre as partes.
dc.descriptionConcluded in the Hague in October 1980, the Hague Convention on the Civil Aspects of the Child Abduction is an instrument of Private International Law that aims to restore the status quo prior to the wrongful removal or retention of the child and determines that the child is to be immediately returned to the place that she or he habitually resided. The law that is applied to solve the issues that arise from custody, access and visitation is the law of the forum of the place in which the child habitually resided, according to the Convention. However, it is argued that this predetermination of forum may not meet the best interest of the child for in some situations the law of the forum might not have kept up with the transformations of the Human Rights Law globally recognised. Given this fact, one solution that can be incorporated is the use of extrajudicial alternative methods of conflict resolution. Among them, mediation comes out as the best option since it humanises the process by bringing anew the focus to the people involved in the relation with the international element, and also by allowing that the parts themselves reach an agreement in their own terms, avoiding in the future that new conflicts emerge between them.
