| dc.description | As interações entre o Direito e a Literatura são antigas. Osestudos destas interações são, no entanto, recentes. Eles datam do SéculoXIX e da segunda metade do Século XX. Nos últimos anos, novos estudoscomparativos de direito e literatura desenvolvem-se. Ao explorar o conjuntode relações existentes entre estes dois antigos campos do conhecimento, taisestudos propõem aplicar os métodos de análise jurídica aos textos literáriose, reciprocamente, aplicar os métodos de análise literária aos textos jurídicos.Esse novo campo de pesquisa deve ser fomentado. Esse texto é um convitepara isso, sobretudo nesta época de “pós-modernidade”, em que se requeruma coexistência pacífica e mutualmente enriquecedora de diferentes cul-turas, cujas expressões mais relevantes são a linguagem e o direito. Para essefim, uma análise diacrônica e sincrônica destas relações jurídicas constituium laboratório de pesquisa em Direito e em Literatura comparados e surgecomo uma das abordagens metodológicas mais apropriadas. | |
| dc.description | The interaction among Literature and law is ancient. On the other hand, the study of this interaction is quite recent, dated from the XIX century until the second half of the XX century. Over the last years a new research environment on Comparative studies on Law and Literature have been developed. By exploring the body of existing relations between these two ancient fields of knowledge, these studies aim for the application of the juridical methods of analysis on literature manuscripts and vice-versa, apply the existing methods for literature analysis to juridical writings. This new field of research must be fur-ther supported and developed. This text is an invitation for a further reflexion on this subject specially at this “post modern” age, where a pacific coexistence and the enriched experience of exchanges of different cultures is so required, and where one of its most relevant expressions are revealed by language and law. For this reason, a diachronic and synchronic analysis of these juridical relations consists of one of the most appropriate methodological approaches and establishes an important research laboratory in Comparative Law and Literature. | |
